Introduction
The following purchase terms and conditions are intended to establish the terms and explain the details of the ticket purchase transaction by users who acquire tickets through this channel from GRUP MEDIAPRO, S.L.U., a commercial company with registered office at Av. Diagonal, 177-183, Edificio Imagina, 08018 Barcelona, Spain, with Tax Identification Number (NIF) B-60188752 and registered with the Commercial Registry of Barcelona, Volume 24885, Folio 156, Sheet B80718 (hereinafter, “MEDIAPRO”).
For any queries, suggestions or complaints, Users may contact the customer service department at the email address info@espai-imagina.com or by telephone on (+34) 93 557 988 (standard rate), and we will respond as soon as possible.
2. Purpose
2.1. These online ticket purchase terms and conditions (hereinafter, the “General Terms and Conditions”) govern the acquisition by the user (hereinafter, the “User”) of admission tickets to the various experiences and/or exhibitions that, from time to time, form part of the exhibition offering of “Espai Imagina” (hereinafter, the “Tickets”) through the website www.espai-imagina.com (hereinafter, the “Website”). These General Terms and Conditions are supplemented by the Privacy Policy, the Legal Advice and the Cookies Policy, which the User must consult through the link available on the Website’s home page before starting the purchase process and which shall be deemed accepted upon acceptance of these General Terms and Conditions.
2.2. 2.2. The User who purchases Tickets through the Website undertakes to comply with them. Express acceptance of these General Terms and Conditions shall take place by clicking the button “I have read and accept the purchase terms and conditions” and entails full and unconditional adherence to these General Terms and Conditions, in the version published at the time the purchase process is commenced. Accordingly, the User must, under their own responsibility, read the General Terms and Conditions carefully. If the User does not agree with the content of these General Terms and Conditions, they must refrain from operating through the Website.
2.3. The online purchase of Tickets must be made by a person of legal age with sufficient capacity to contract. Therefore, the User represents that they are of legal age, in accordance with their national law, and have the legal capacity required to be bound by these General Terms and Conditions, and to use and, where applicable, contract through the Website in accordance with them. The User represents that they know, understand and accept them in full. Notwithstanding the foregoing, Tickets may be used by minors as visitors, provided that the access and accompaniment conditions set out in these General Terms and Conditions are complied with.
2.4. The User also undertakes to comply with the health measures established from time to time.
2.5. 2.5. MEDIAPRO reserves the right to deny or withdraw access to and/or use of its purchase service from the Website, at any time and without prior notice, to Users who provide false information or who otherwise breach the General Terms and Conditions.
2.6. 2.6. MEDIAPRO does not guarantee the availability or continuity of the Ticket purchase service regulated herein, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. These General Terms and Conditions are those in force as from the date of their last update (indicated at the end of this document). MEDIAPRO may amend these General Terms and Conditions at any time, without such amendments affecting purchases already completed, which shall be governed by the version accepted by the User at the time of contracting. In such case, the amendments shall enter into force upon publication and shall apply exclusively to Users who access the Website after that date. For the avoidance of doubt, if these General Terms and Conditions are amended, in strict compliance with the applicable consumer and user protection regulations, MEDIAPRO shall respect the commitments and agreements entered into with Users before such amendment, provided that they are applicable.
2.7. If the User acts as a consumer, the contract shall be presumed to have been concluded at the place where the User has their habitual residence. However, the contract shall be deemed concluded at MEDIAPRO’s registered office where the User does not act as a consumer.
2.8. 2.8. The General Terms and Conditions shall be kept by MEDIAPRO and shall be available and accessible from the Website, so that the User may consult and review them at any time.
2.9. The General Terms and Conditions are available in Catalan, Spanish and English.
2.10. 2.10. If any provision of these General Terms and Conditions becomes null and void or unenforceable for legal or material reasons, the remaining provisions shall not be affected and shall continue to apply, provided that they are not affected by such nullity or unenforceability.
3. Ticket Purchase Service
3.1. This Website has been developed for the benefit of end customers and, therefore, the services accessible through it are not aimed at wholesalers, retailers or any type of intermediary, whether in the leisure, tourism or any other sector. Accordingly, the User acknowledges and accepts that the Website is solely and exclusively for personal use and represents that the services contracted through the Website shall be for their own use, the User being responsible for any access to, use of or contracting of the services offered on the Website by third parties who access, use or contract them on the User’s behalf. In this regard, the User expressly and unreservedly accepts that access to the Website and use of its services take place under the User’s sole and exclusive responsibility.
3.2. 3.2. Through the Website, MEDIAPRO makes available to the User an advance Ticket sale service to access the various experiences and/or exhibitions that, from time to time, form part of the exhibition offered in Espai Imagina.
3.3. The User may purchase the types of Tickets described in the “Plan your visit” section of the Website, all of which shall be subject to these General Terms and Conditions.
3.4. The Website itself shall inform the User of those types of Tickets for which an audio guide is available, which may, where applicable, be accessed through a mobile application (PWA) by means of a QR code or in the manner expressly notified to the User.
4. Ticket Purchase Procedure 4.1. To make an online purchase of Tickets, the User must follow the steps below:
i. First, the User must have a computer, smartphone or any other type of electronic device with an internet connection and go to the “Tickets” section of the Website.
ii. Once the User has accessed the Ticket sales section of the Website, the User must indicate the type of Tickets they wish to purchase, according to the options available on the Website. Once the Ticket type has been selected, the User must choose the specific date and time on which they wish to make the visit, as well as the number of Tickets they wish to purchase. The Website shall inform the User of the maximum number of Tickets that may be purchased for the selected date and time. The date and time of the visit shall be those stated on the Ticket after completion of the purchase process.
iii. In the case of Tickets at a reduced rate, the User must also indicate the type of beneficiary who will use the Tickets, as well as the applicable type of reduction. The User undertakes to provide truthful information at all times. MEDIAPRO may deny access to visitors who, having selected this Ticket type, do not meet the requirements described for the reduced rate.
iv. Based on the number and type of Tickets selected by the User, the Website shall indicate the final purchase price of the Tickets (which shall include VAT or any other applicable taxes or charges). The price of the Tickets shall be the price stated on the Website at the time of purchase. The total price of the Tickets, including taxes and, where applicable, any management fees or applicable charges, shall be displayed in itemised form before the User confirms the purchase. No additional charges shall apply unless previously notified to the User before completion of the purchase process.
v. Once the User has selected all the options mentioned above, the User must provide the following details: first name and surname(s), an email address and postcode (all fields being mandatory).
vi. The User shall then be asked to select the payment method with which they wish to make their purchase. The Tickets available on the Website may be purchased through the various payment methods, such as debit or credit bank cards, identified on the Website itself. MEDIAPRO reserves the right to incorporate new payment methods in the future, which shall be duly notified to the User through the Website.
vii. Before being able to continue with the purchase, the User must expressly accept these General Terms and Conditions, as well as the Privacy Policy and any other terms and conditions applicable to the purchase of the Tickets, which shall be previously notified and made available to the User.
viii. Finally, after selecting the payment method and clicking the “Pay” button, the User shall be redirected to the payment platform of the relevant financial institution and must follow the payment instructions provided by it.
The contract between the User and MEDIAPRO for the purchase of Tickets shall be perfected at the time the User successfully completes the Ticket payment process. The User represents that they know and accept that only the complete fulfilment and following of the purchase procedure provided for on the Website, which ends with confirmation of the purchase by the << User in the “Confirmation” dialogue box, constitutes a complete, formal and effective request to purchase the Tickets. Under no circumstances shall the partial execution of the purchase procedure by the User create any contractual or pre-contractual relationship between the User and MEDIAPRO.
Before completing the Ticket purchase process, it shall be the User’s responsibility to ensure the accuracy and correctness of the data entered. Once the Ticket purchase process has been duly completed, the characteristics, types and conditions of the Tickets (such as, for example, the date or time of the visit) may not be modified, except in the cases expressly provided for in these General Terms and Conditions.
The User represents and warrants to MEDIAPRO that they have the legal capacity required to act, contract and purchase the Tickets through the Website, that they will duly complete all data requested during the contracting process and that the data they enter are truthful, up to date and do not correspond to any third party. In the case of contracts entered into by minors, MEDIAPRO shall not be liable for the validity of the consent given to contract or for any need for such contracting to be ratified by their legal representatives. Nor shall MEDIAPRO be responsible for verifying the truthfulness or accuracy of the data provided by Users. Therefore, MEDIAPRO shall not assume any liability for persons who breach their obligations to provide their own, certain, truthful and lawful information, such persons being solely liable for all purposes for any false or inaccurate data they enter during the contracting process, as well as for any damages of any kind caused to MEDIAPRO and/or third parties as a result thereof.
xii. Once the purchase process has been completed, the User shall receive an email at the email address provided for this purpose, confirming the purchase of the Tickets and containing the booking locator number and the Tickets purchased. The Tickets may be printed, downloaded to the mobile device in PDF format or downloaded in Passbook or Wallet format. Tickets in these three formats shall have the same validity as those purchased at ticket offices. The Tickets shall have a unique locator and may only be used once.
4.2. 4.2. Under no circumstances is the purchase of Tickets through the Website permitted for purposes other than those expressly provided for in these General Terms and Conditions. The User may not resell the Tickets for a price or carry out any onerous legal act transferring the use of the Ticket or ownership thereof to third parties.
4.3. 4.3. MEDIAPRO is only responsible for Tickets purchased through the Website.
4.4. 4.4. The resale of Tickets is expressly prohibited.
5. General Access and Visit Rules
5.1. 5.1. Access to Espai Imagina is subject to possession of a Ticket validly acquired in accordance with these General Terms and Conditions and duly presented to MEDIAPRO staff on the agreed date and time of the visit. In any event, minors under 14 years of age must be accompanied by an adult.
5.2. 5.2. The User who has purchased Tickets online must attend the access point available for this purpose at the time indicated during the purchase process. Once the Ticket has been validated by MEDIAPRO staff and the legitimate Ticket holder has accessed the premises, the visitor may not re-enter if they leave. Visitors must keep the Ticket throughout the visit.
5.3. MEDIAPRO staff may at any time require visitors who have purchased Tickets at a reduced rate to provide documentary evidence that they meet the circumstance giving rise to the reduction.
5.4. 5.4. MEDIAPRO staff may deny access to Espai Imagina if the Ticket is damaged, torn or shows signs of counterfeiting or resale. If a counterfeit or resold Ticket is detected, MEDIAPRO reserves the right to bring legal action against the person presenting it or against the person responsible for the counterfeiting or resale.
5.5. MEDIAPRO reserves the right, for security reasons and pursuant to the applicable regulations, to search visitors accessing Espai Imagina, as well as their belongings. Visitors may be subject to checks of bags, backpacks, luggage and personal effects. Under no circumstances is entry permitted with objects that may be considered dangerous or prohibited. If a dangerous object is detected, the object may be confiscated until exit or handed over to the law enforcement authorities, as the case may be, or the visitor may be denied access. Such measures may be unilaterally modified by MEDIAPRO where circumstances so require, such as, for example, changes in the Anti-Terrorism Alert Level (NAA).
5.6. MEDIAPRO reserves the right of admission pursuant to Decree 112/2010, of 31 August, approving the Regulations on public performances and recreational activities. The right of admission shall be exercised in accordance with the applicable regulations, objectively, proportionately and without discrimination, and exclusively on grounds relating to security, compliance with access rules, Ticket validity or the protection of persons and facilities. MEDIAPRO may also deny access or continued stay to any visitor who:
(i) shows symptoms evidencing that they are under the influence of alcoholic beverages, narcotics, psychotropic substances, stimulants or equivalent substances;
(ii) displays behaviour that entails or may entail a direct or indirect danger to other persons, MEDIAPRO staff and/or the facilities; and/or
(iii) breaches any of the rules established in these General Terms and Conditions. The right of admission may also be applied to visitors who, having accessed Espai Imagina, attempt to access other areas of the building or premises where it is located, in breach of any of the rules established in this clause or in the General Terms and Conditions.
5.7. 5.7. The purchase of the Ticket to access Espai Imagina entails the User’s acceptance of the regulations in force established by the Ministry of Health or any other competent authority at any time for visits to exhibition or display spaces and public establishments, as a consequence of possible public health emergency situations.
5.8. 5.8. MEDIAPRO reserves the right to modify routes or limit the visitable areas for reasons of public health, security, restoration, maintenance or specific events. As a general rule, such changes shall not affect the Ticket price or entitle the User to any claim. Without prejudice to the foregoing, where such modification entails a substantial alteration of the contracted experience or prevents provision of the service on the essential terms contracted, the User shall be entitled to request a change of date, under the terms established in these General Terms and Conditions.
5.9. 5.9. MEDIAPRO shall, in compliance with applicable law, regulate the capacity of Espai Imagina according to safety and/or space conservation criteria.
5.10. Smoking, drinking and eating are not permitted within the exhibition route of Espai Imagina, except at points which, where applicable, are expressly authorised for such purpose.
5.11. In order to preserve hygiene, for safety reasons, and out of courtesy and respect for others, remaining on the premises in a swimsuit, bikini, without footwear or bare-chested shall not be permitted.
5.12. For health and hygiene reasons, animals are not admitted, except for guide dogs.
5.13. Scooters, bicycles and any other wheeled vehicles are not permitted anywhere on the premises.
5.14. Access to Espai Imagina with professional audiovisual equipment (including, by way of example, flashes or lighting devices, tripods, lenses, etc.) is not permitted. Nor is it permitted to capture images for purposes other than personal use. In particular, the use of images for profit-making, business or professional purposes is prohibited without MEDIAPRO’s express prior written consent. If the User breaches this obligation, the User shall assume full liability that may arise vis-à-vis MEDIAPRO and/or third parties for the unauthorised capture and use of any image of the premises.
6. Withdrawal and Change and Refund Policy
6.1. Right of withdrawal: In accordance with Article 103.l) of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other supplementary laws, the right of withdrawal shall not apply to the purchase of Tickets where they relate to services connected with leisure activities and the contract provides for a specific date or period of performance. Accordingly, once the purchase has been confirmed, the User may not freely withdraw from it, without prejudice to the rights to change or refund expressly provided for in these General Terms and Conditions and to any rights legally corresponding to the User in the event of cancellation, impossibility of providing the service or breach attributable to MEDIAPRO.
6.2. Changes for individual Tickets: As a general rule, once the Tickets have been purchased, the User may change the date and time of the Ticket provided that the User requests this no later than 24 hours before the visit. Any change request must be processed by sending an email to info@espai-imagina.com or by telephone on (+34) 93 557 988 Ticket changes are personal, i.e. they may only be requested by the User who purchased them. MEDIAPRO shall not process and/or authorise changes to Tickets purchased through intermediaries or unauthorised distributors, which must be processed with such third parties and in accordance with their own terms and conditions. Only unused Tickets may be changed. The request must include presentation of the Tickets, in digital or paper format, and the booking locator number. A new date may be chosen within the calendar year from the date of the request, and it shall be mandatory to exchange the Ticket for a new Ticket with a date and time through the same email address info@espai-imagina.com or by telephone on (+34) 93 557 988. The date change shall correspond to the original Ticket, which shall have the same characteristics, types and services as the original Ticket. In any event, the change request shall be subject to Ticket availability. The change shall not entail any charge for the User.
6.3. Refunds for individual Tickets: As a general rule, once the Tickets have been purchased by the User, MEDIAPRO shall only accept cancellations with a right to a refund for requests submitted no later than 24 hours before the visit, provided that any of the following situations occurs:
(a) duly evidenced force majeure events;
(b) cancellation of the trip or impossibility of attending the visit for duly evidenced medical reasons directly affecting the User and/or a first- or second-degree relative, with this case being understood to include only cases of death, serious illness or hospitalisation;
(c) cancellation of the trip for reasons beyond the User’s control, such as flight cancellation by the airline, which must be duly evidenced;
(d) for duly evidenced reasons entirely beyond the User’s control; and
(e) for reasons attributable to MEDIAPRO, such as the closure of Espai Imagina for maintenance work, holding of events, etc.Refunds must always be requested at least 24 hours before the date of the visit and an official supporting document must be submitted proving that the visit cannot be made for any of the reasons set out above. Ticket refunds are personal, i.e. they may only be requested by the User who purchased them. MEDIAPRO shall not process or authorise refunds of Tickets purchased through intermediaries or unauthorised distributors, which must be processed with such third parties and in accordance with their own terms and conditions, MEDIAPRO assuming no liability in this respect.
6.4. 6.4. Refund procedure
i. Any refund request must be processed by sending an email to info@espai-imagina.com or by telephone on (+34) 93 557 988 and an official supporting document must be submitted setting out the reasons why it is not possible to make the visit.
ii. Only unused Tickets shall be refunded. The request must include presentation of the Tickets, in digital or paper format, and the booking locator number.
iii. MEDIAPRO evaluates each request and resolves each request based on the documentation provided, communicating to the User the reasoned acceptance or rejection of the request.
iv. In the event of acceptance, MEDIAPRO will order the refund without undue delay, through the same means of payment used by the User in the purchase.
v. The refund shall only include the price of the Tickets paid by the User. Under no circumstances shall the User be reimbursed for any other cost or expense, such as, by way of example, transport or accommodation costs, nor any management fees applied to the purchase of the Ticket.
vi. In cases of refunds or date changes due to closure of services and/or closure of Espai Imagina by decision of MEDIAPRO, the refund will be made automatically without the need for prior request. The User may in any case request the date change through info@espai-imagina.com.
vii. In cases of refunds for a cause not attributable to the User or to third parties unrelated to MEDIAPRO (for example, force majeure events or as a consequence of measures adopted by competent authorities), the request must be made through the same email address info@espai-imagina.com or by telephone on (+34) 93 557 988 and documentation must be submitted to justify the impossibility of making the visit.
6.5. 6.5. Changes for group Tickets
Group visit rate (more than 10 persons): To request a change of date or time for a group booking, this may be done upon prior request and subject to availability, no later than 48 hours before the visit. Any change request must be processed by sending an email to info@espai-imagina.com by telephone on (+34) 93 557 988 and all provisions applicable to the change procedures for individual Tickets shall apply (except for the time limit).
School visit rate: To request a change of date and time for a school booking, this may be done upon prior request and subject to availability, made at least 7 business days before the visit. Any change request must be processed by sending an email to educa@espai-imagina.com, and all provisions applicable to the change procedures for individual Tickets shall apply (except for the time limit).
6.6. 6.6. Refunds for group Tickets:
Group visit rate (more than 10 persons): Refund requests made more than 3 business days before the scheduled visit time shall entitle the User to a refund of 100% of the Ticket price, and refund requests made less than 3 business days before the date and time of the visit shall not give rise to any refund and only the date and time of the visit may be changed, subject to availability. Any refund request must be processed by sending an email to info@ espai-imagina.com or by telephone on (+34) 93 557 988, and all provisions applicable to the refund procedures for individual Tickets shall apply (except for the time limit).
School visit rate: Refund requests made more than 1 month before the scheduled visit time shall entitle the User to a refund of 100% of the Ticket price, and refund requests made between 30 and 15 business days before the scheduled visit time shall entitle the User to a refund of 70% of the Ticket price. Refund requests made less than 15 business days before the date and time of the visit shall not give rise to any refund and only the date and time of the visit may be changed, subject to availability. Any refund request must be processed by sending an email to educa@espai-imagina.com, and all provisions applicable to the refund procedures for individual Tickets shall apply (except for the time limit).
7. Intellectual and Industrial Property Rights
7.1. 7.1. The intellectual and industrial property rights in the Website, Espai Imagina and the various experiences and/or exhibitions organised there, as well as in all their elements and contents, are exclusively owned by MEDIAPRO or by third parties, or have been lawfully assigned or licensed to MEDIAPRO. Accordingly, the use, reproduction, transmission, transformation, dissemination, disclosure, publication, processing, distribution, public communication or exploitation of the Website, Espai Imagina and the various experiences and/or exhibitions organised there, in any manner, by the User is prohibited, except for those uses strictly necessary for the use of the services offered through the Website or those permitted by law. The User acknowledges and accepts that use of the Website or acquisition of Tickets does not entail the transfer of any intellectual or industrial property right, such as copyrights, trademarks, designs or other rights.
7.2. 7.2. The User shall be solely liable, vis-à-vis MEDIAPRO and vis-à-vis third parties, for any infringement of intellectual, industrial or analogous property rights carried out in relation to the Website, Espai Imagina and the various experiences and/or exhibitions organised there.
8. Liabilities
8.1. 8.1. MEDIAPRO shall assume no liability whatsoever in respect of any Ticket not purchased through the Website.
8.2. MEDIAPRO shall not be liable for any loss or theft of Tickets.
8.3. 8.3. During the visit, visitors must scrupulously follow all rules, indications and safety instructions communicated by MEDIAPRO and/or all those applicable, acting with appropriate diligence and precautionary measures. In this regard, MEDIAPRO shall in no event be liable for any damage, loss, cost or expense suffered by visitors or third parties as a result of a breach of or failure to observe such rules, indications or instructions or, in general, as a result of any negligent act or omission on their part or on the part of any third party unrelated to MEDIAPRO.
8.4. 8.4. MEDIAPRO shall in no event be liable for the loss or theft of visitors’ personal belongings during their visit due to acts or omissions of third parties not attributable to MEDIAPRO.
8.5. 8.5. Visitors shall be exclusively liable, and shall be liable vis-à-vis MEDIAPRO and third parties, for any damage, deterioration or loss they cause to the facilities and/or to third parties during visits, without any limitation, provided that such damage is actual, proven and attributable to the visitor.
8.6. 8.6. Nothing in these General Terms and Conditions shall exclude or limit MEDIAPRO’s liability in cases where such liability is legally enforceable, including cases of wilful misconduct, fault or negligence attributable to MEDIAPRO, breach of legal or contractual obligations, or any other cases in which the applicable regulations do not permit liability towards consumers and users to be limited or excluded.
9. Applicable Law and Jurisdiction
9.1. These General Terms and Conditions shall be governed by Spanish common law, to the extent permitted by the special national legislation applicable to Users who qualify as consumers.
9.2. Any dispute that may arise in connection with this contractual relationship shall be submitted to the competent courts of the city of Barcelona (Spain), to the extent permitted by the special national legislation applicable to Users who qualify as consumers.
9.3. Likewise, where the User acts in their capacity as a consumer, the User may resort to the alternative dispute resolution mechanisms applicable in consumer matters pursuant to the regulations in force. However, unless legally required, MEDIAPRO does not generally undertake to participate in alternative dispute resolution proceedings.
