This text is constituted as the Legal Notice and the Conditions of Use that regulate the access, navigation and use of this website owned by GRUP MEDIAPRO, S.L.U., (hereinafter “MEDIAPRO” or the “Provider“), a trading company with registered office at Av. Diagonal, 177-183, Planta 12, Edificio Imagina, 08018 Barcelona with NIF:  B60188752 and registered in the Mercantile Registry of Barcelona Volume 24885, Folio 156, Page B80718.

2. General Terms and Conditions of Use

The use of the services that can be accessed through the Website www.espai-imagina.com or other web pages redirected to said website (hereinafter, jointly referred to as the “Website“), as well as the Social Network profiles owned by MEDIAPRO, are subject to this Legal Notice and Conditions of Use of the Website.

3. General Conditions and their acceptance

This Legal Notice and Conditions of Use of the Website (hereinafter, the “General Conditions“) regulate access to and use of the Website as well as the different Social Network profiles owned by MEDIAPRO, including the contents, understood as texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, etc.  images, expressions and information, as well as any other creation protected by national laws and international treaties on intellectual and industrial property, (hereinafter, the “Contents”) and the services (hereinafter, the “Services“) that MEDIAPRO makes available to users of the Website and Social Networks.

MEDIAPRO is not subject to prior administrative authorisation and does not carry out a regulated professional activity. If required in the future, this information will be duly updated in this Legal Notice.

Access to the Contents and/or the use of the Services confers the status of user (hereinafter, the “User“) and entails acceptance of the General Conditions in the latest version published by MEDIAPRO on the Website at the time the User accesses them, so if they do not agree with the content of the same, they must refrain from accessing and/or using the Services and/ o Content offered by MEDIAPRO.

These General Conditions do not exclude the possibility that certain Services, Content and/or tools offered through the Website and Social Networks may be subject to specific conditions, in which case, they will be made available to the User.

4. Purpose

These General Terms and Conditions regulate access to the Contents and all the Services offered by MEDIAPRO through its Website and Social Network profiles owned by it, through which a set of content and information of various kinds is made available to Users, generally referring to the products and services marketed by MEDIAPRO.  or the companies of the business group to which it belongs. However, it reserves the right to modify the presentation, configuration and content of the Website and corresponding Social Network profiles, the Services, as well as the conditions required for their access and/or use. Access to and use of the Content and Services after the entry into force of their modifications or changes in the conditions implies acceptance of these.

5. Conditions of access and use of the Services

5.1. Access

Access to the Contents and the use of the Services provided by MEDIAPRO through the Website and its Social Networks is generally free of charge for Users.

However, access to certain Content and Services may be conditional on a subscription that entails a consideration. In this case, the user will be informed in advance about the applicable conditions, including, among other aspects, the price, the corresponding taxes and, where applicable, the shipping costs, before formalizing the contract.

5.2. Minors

In order to use the Services and access the Contents, minors must first obtain permission from their parents, guardians or legal representatives, who will be held responsible for all acts carried out by the minors in their care.

Full responsibility for determining the specific Content and Services accessed by minors corresponds to the adults in whose charge they are. 5.3. Obligation to make correct use of the Website, Services and Content

The User undertakes to use the Website and the Services and to access the Contents, in accordance with the law, these General Conditions, the Particular Conditions of certain Services and other notices, regulations of use and instructions made known to him/her.

(b) induces, incites or promotes acts that are criminal, denigrating, defamatory, defamatory, violent or, in general, contrary to the law, morality and generally accepted good customs or public order;

(c) induces, incites or promotes discriminatory actions, attitudes or thoughts on grounds of gender, race, religion, beliefs, age or condition;

(h) is protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorisation from its owners to carry out the use it makes or intends to make;

(i) violates the trade secrets of any third party;

(j) is contrary to the right to honour, personal and family privacy or the self-image of individuals, including the unauthorised dissemination of personal data or private information, as well as any processing or disclosure of data that violates the applicable regulations on the protection of personal data;

(k) in any way undermines the credit of MEDIAPRO or third parties;

(l) violates the regulations on the secrecy of communications;

(m) constitutes, where appropriate, unlawful, misleading or unfair advertising and, in general, constitutes unfair competition;

(n) incorporates viruses or other physical or electronic elements that may damage or impede the normal functioning of the network, system or computer equipment of MEDIAPRO or third parties or that may damage the electronic documents and files stored on such computer equipment;

(o) causes, due to its characteristics (such as format, length, etc.), difficulties in the normal functioning of the Service.

6. Links

6.1. Links to other websites or profiles of third parties on Social Networks

In the event that the Website or Social Network profiles, owned by MEDIAPRO, show links to other websites or profiles of third parties on Social Networks, by means of different buttons, links, banners or embedded content, MEDIAPRO informs that these are directly managed by third parties, and MEDIAPRO does not have the human or technical means to know in advance and/or control and/or approve all the information.  content, products or services provided by third parties to which MEDIAPRO may establish links.

Consequently, MEDIAPRO cannot assume any type of responsibility for any aspect related to the platform or website, Social Network to which a link may be established from the Website or Social Network profiles owned by MEDIAPRO, specifically, by way of example and without limitation, regarding its operation, access, data,  information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.

In this regard, if users have effective knowledge that the activities carried out through these websites or profiles of third parties are illegal or contravene morality and/or public order, they must immediately notify MEDIAPRO at the address or in the contact emails that appear in these General Conditions for the purpose of disabling the access link to them.  action that will be carried out in the shortest possible time.

6.2. Ticket sales through third-party platforms

The Website may include links that redirect to external ticketing platforms operated by third parties. MEDIAPRO does not intervene in the purchase process, does not manage payments or respond to incidents related to the acquisition, return, cancellation or use of tickets. The contract will be governed by the terms and conditions of the external platform, therefore, the User must review the conditions of the sales platform and any legal texts made available to them before buying.

6.3. Links to the Provider’s channel on other platforms and social networks

MEDIAPRO makes available to Users, through different tools and applications, means of links that allow Users to access the channels and web pages that MEDIAPRO maintains on different platforms and, where appropriate, Social Networks belonging to and/or managed by third parties (e.g. Facebook, X, etc.). The inclusion of these links on the Website is for the sole purpose of providing users with access to these channels on the different platforms and, where appropriate, Social Networks.

The establishment of these applications does not imply the existence of any relationship between MEDIAPRO and the owner, manufacturer or distributor of the linked platform, nor the acceptance and approval by MEDIAPRO of its contents and/or services, with its owner, manufacturer or distributor being solely responsible for these.

The activation and use of these applications may entail the identification and authentication of the user (login/password) on the corresponding platforms, completely external to the Website and beyond the control of MEDIAPRO.

By accessing these external networks, the User enters an environment not controlled by MEDIAPRO, so MEDIAPRO will not assume any responsibility for the security configuration of these environments, for the content or services that the User may access on said pages and, where appropriate, social networks, or for any content,  products, services, advertising, or any other materials available therein. For this reason, the User must carefully read the legal notices, privacy policies, conditions of use and any other informative text available on each of the platforms or Social Networks to which they access and must exercise extreme caution in the custody of their username and password and the use of the information, content and services existing in the linked channels.  and about your own or third-party information that you want to share on those channels.

Therefore, MEDIAPRO does not assume any type of responsibility for any aspect related to the website or Social Network that establishes that link to the Website or MEDIAPRO profile on any Social Networks, specifically, by way of example and not exhaustive, on its operation, access, data, information, files, quality and reliability of its products and services,  its own links and/or any of its contents, in general.

MEDIAPRO does not authorise the establishment of a link to the Website or its profiles on Social Networks from those pages or profiles of third parties that contain materials, information or content that is illicit, illegal, degrading, obscene and, in general, that contravenes the laws, morality or public order, or generally accepted social norms.

In any case, Users may establish links on their respective websites or profiles on Social Networks that direct MEDIAPRO, provided that they comply with the following conditions: a) the link may not reproduce the content of the Website or parts of it in any way; b) it is not permitted to create a browser on the sections of the Website, nor may the Website or the Content and/or Services published therein or on MEDIAPRO’s Social Network profiles be modified in any other way; c) it is not permitted to make false, inaccurate or incorrect statements or indications about the Website or the profiles that MEDIAPRO may manage on the Social Networks and/or, in particular, to declare or imply that MEDIAPRO has authorised the link or that it has supervised or assumed in any way the content or services offered or made available on the website or profile on the corresponding Social Network in which this link is established; d) the website or profile on which the link to the Website is established or, where appropriate, MEDIAPRO profiles on Social Networks will not contain information or content that is illegal, contrary to generally accepted morality and good customs and public order, nor will it contain content contrary to any rights of third parties,  including intellectual and industrial property rights and/or the right to honour, personal or family privacy or one’s own image or any other right, or content contrary to the rules governing the protection of personal data, e) the owner of the website or profile on a Social Network in which the link to the Website is established or,  where appropriate, MEDIAPRO’s corresponding Social Network profiles may not profit, either directly or indirectly, from the inclusion of link(s) to the Website or Social Network.

7. Liability for damages

The User will be liable for the breach of any of the obligations to which he/she is subject by virtue of these General Conditions or of the applicable law in relation to the use of the Services and access to the Contents.

8. Exclusion of Warranties and Liability

MEDIAPRO makes its best efforts to ensure the proper functioning of the Website and the content and services offered through it and, where appropriate, its official profiles on social networks. However, the User understands that interruptions, technical errors or unavailability may occur due to factors beyond MEDIAPRO’s control. Where reasonably possible, MEDIAPRO will give advance notice of scheduled interruptions.

MEDIAPRO does not guarantee:

1. The continuity, availability or updating of the contents of the Website or of MEDIAPRO’s official profiles on social networks (such as Facebook, X, Instagram, YouTube or TikTok).
2. The absence of errors in the information or materials published both on the Website and on said platforms, without prejudice to MEDIAPRO’s commitment to correct them as soon as possible.
3. The absence of viruses, malicious elements or attacks that may affect the Website, social networks or the servers that host them, although it has adopted reasonable measures to prevent them.
4. The technical invulnerability of the Website or social media profiles, or the impossibility for third parties to breach its security measures.
5. The suitability or usefulness of the contents of the Website or social networks for the User’s specific purposes.

With respect to social networks, the User expressly acknowledges that:

• The platforms are owned and managed by third parties outside MEDIAPRO, which apply their own conditions of use, privacy policies and operating rules.
• MEDIAPRO does not control and cannot guarantee the changes that such platforms make to their configuration, availability, operation or algorithms.
• The content published by third parties (users or other profiles) on social networks is not the responsibility of MEDIAPRO and may be modified or deleted without its intervention.
• Comments, opinions or publications made by users on the profiles managed by MEDIAPRO are the sole responsibility of those who issue them. MEDIAPRO does not assume responsibility for such content, although it may moderate or remove it when it is illicit, offensive or violates the applicable regulations.

Likewise, MEDIAPRO does not guarantee the legality, accuracy, reliability or usefulness of the content from third parties and incorporated into the Website or shown through social networks or external platforms. If the user becomes aware of the existence of any content that is unlawful, illegal, contrary to the law or that could constitute an infringement of the rights of third parties, they must immediately notify MEDIAPRO, so that it can proceed to adopt the appropriate measures.

Under no circumstances will MEDIAPRO be liable for damages arising from:

• improper use of the Website or social media profiles;
• technical failures, interruptions or unavailability of the service;
• unauthorized access or security breaches by third parties;
• the existence of illegal, inaccurate or outdated content published by third parties on social networks or linked websites;
• decisions made by the User based on the information contained on the Website or on social networks.

The foregoing is without prejudice to the legally enforceable obligations of MEDIAPRO in accordance with current regulations, especially in terms of personal data protection

9. Intellectual and industrial property rights

The Website and the different elements that are integrated into it as well as, where appropriate, in the Social Network profiles managed by MEDIAPRO, such as databases, computer applications, distinctive signs, logos, photographs, fragments of audiovisual works, graphic designs or any others, are subject to intellectual and industrial property rights of which MEDIAPRO is the exclusive owner or assignee with the required scope. These General Terms and Conditions do not imply the assignment or transfer in favour of the User of any intellectual or industrial property rights over the Website, or over the corresponding MEDIAPRO Social Network profiles, or over any of its component elements. The User is expressly prohibited from reproducing, distributing, transforming, publicly communicating, making available, extracting, reusing, forwarding or exploiting by any means or procedure the Website or the Contents and/or Services of MEDIAPRO, except in cases where it is legally permitted or with the express written authorisation of MEDIAPRO.

The User may view the Content available through the Website or, where appropriate, on their Social Network profiles for their exclusive personal and private use on their computer systems, provided that it is not for the purpose of carrying out activities of a commercial or professional nature. The User must refrain from circumventing or trying to circumvent any technological measures adopted by MEDIAPRO to restrict acts that do not have the authorisation of MEDIAPRO or third party holders of rights over protected works or services accessible through the Website or their profiles on Social Networks. The User must respect at all times all intellectual and industrial property rights over the Website and, where appropriate, corresponding profiles on Social Networks, whether owned by MEDIAPRO or by third parties.

12. Applicable law and jurisdiction

The relations established between the User and MEDIAPRO will be governed by Spanish law. However, in cases in which the regulations provide for the possibility for the parties to submit to a jurisdiction, the User and MEDIAPRO, expressly waiving any other jurisdiction that may correspond to them, will submit any controversies and/or litigation to the Courts and Tribunals of the city of Barcelona.
